NOTICE TO BIDDERS is hereby given that sealed Bids are invited and will be received as set forth herein.

OWNER: Borough of Wharton, Morris County, New Jersey

PROJECT TITLE: Wharton Public Library Windows and Reroofing – Bid 2024-01

GENERAL DESCRIPTION OF PROJECT: This project entails the removal and replacement of existing windows on the lower and upper levels, and the removal and replacement of the roofing at the Borough’s library.

EXAMINATION OF CONTRACT DOCUMENTS:

Contract Documents may be examined Monday through Friday, except legal holidays, from 9:00AM to 4:00PM, only at the office of the Architect at the address set forth above.

OBTAINING CONTRACT DOCUMENTS:

Contract Documents may be obtained only from the office of the Architect starting March 8, 2024 at the address and hours set forth above upon payment of Fifty dollars ($50.00) for each hardcopy set of Contract Documents.  PDFs of the documents can be obtained at no charge by emailing a request to the architect at bids@foxarch.com.  Bidder must provide full contact information minimally including: requester name, company name, address, phone number, fax number, and email address. If bid documents are obtained from any source other than from the Architect, then it is the responsibility of the bidder and/or the plan service or entity providing those documents to the bidder, to verify any bidder to whom the bid documents were provided receives the full set of bid documents, including any Addenda.  The Architect and the Borough are not be responsible for any missing bid documents and/or deficient bid submitted based on incomplete or missing bid documents.  It is each bidder’s responsibility to ensure that it is bidding based on a complete bid document package as distributed by the Architect.

BID SECURITY:

Bid Security is required in an amount of not less than ten percent (10%) of the total amount of the Bid, but not in excess of Twenty Thousand Dollars ($20,000.00) as set forth in N.J.S.A. 40A:11-21

CONSENT OF SURETY:

Certificate from a Surety Company is required indicating consent to be bound as surety and guarantor for performance required under the Contract Documents.

PRE-BID CONFERENCE:

A Pre-Bid Conference will be held on Tuesday, March 19, 2024  at the project site.  Attendance is not mandatory, but is strongly recommended.  Please note that failure to attend does not relieve the bidder of any obligations or requirements.

BID SUBMISSION PROCEDURES:

Bids must be submitted on the Bid Form contained in the Contract Documents and must be enclosed in a sealed envelope plainly marked on the outside with the name of project and the name and address of the Bidder.  The Bid must be delivered to the Owner prior to Bid opening at the above address for submitting Bids.  Bids will not be accepted after Tuesday March 28, 2024 at 11:00 AM.

CONTRACTOR REGISTRATION:

Bidders are required to be registered by the New Jersey Department of Labor at the time bids will be received by the Project Owner pursuant to the Public Works Contractor Registration Act (P.L. 2003, c. 91, N.J.S.A. 34:11-56.51).  Effective September 1, 2004, Bidders are also required to be registered by the New Jersey Department of Treasury, Division of Revenue at the time bids will be received by the Project owner pursuant to the Business Registration Act (P.L.2004, c.57, N.J.S.A.52:32-44)..

STATUTORY REQUIREMENTS:

Bidders are required to comply with applicable statutory requirements set forth in the Contract Documents including the requirements of N.J.S.A. 10:5-31, et seq. & N.J.A.C. 17:27-1.1, et seq. (Affirmative Action); P.L. 1963, c. 150 (Prevailing Wage); Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et seq.); and P.L.2004, c.19 & P.L.2005, c.271 (Pay to Play). 

MORRIS COUNTY COMMUNITY DEVELOPMENT PROGRAM REQUIREMENTS:

Funding for this project is provided by the United States Department of Housing and Urban Development to the County of Morris. Therefore, the Federal Labor Standards Provisions and Davis Bacon wage rates and reporting will apply. Attention is called to the fact that the contractor must ensure that employees and applicants for employment are not discriminated against because of their age, race, creed, color, national origin, ancestry, marital status, sex, affectional or sexual orientation and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Small, Minority and Women's Business Enterprises, and Section 3 businesses (contracts over $200,000) are encouraged to submit bids.

REJECTION OF BIDS:

The Borough of Wharton reserves the right to reject any or all Bids, or to waive any Bid defect where such defect is not detrimental to the best interest of Borough of Wharton and fairness of the bidding process.  The right is also reserved to increase or decrease the quantities specified in the manner designated in the Contract Documents.

Wharton is a community of approximately 6,500 residents in the highlands of Morris County. Wharton is located between Routes 15, 46 and 80, stretching south from the main entrance of Picatinny Arsenal, a major army research and development center, to Route 46 abounded on the west by Roxbury Township and the east by Dover and Rockaway Township. The Borough is approximately 2.2 square miles.
