NOTICE TO BIDDERS
Fields at Orchard Mine - Phase 1

NOTICE TO BIDDERS is hereby given that sealed bids are invited and will be received as set forth herein.

OWNER: Borough of Wharton, 10 Robert Street, Wharton, NJ 07885, Morris County, NJ

DESCRIPTION: Phase 1 of this project consists of site demolition, clearing, cleanup, stockpiling or removal of materials, and restoration activities.

NON-MANDATORY PRE-BID TOUR:

A non-mandatory pre-bid walk through of the project will be conducted so that the bidders can review the actual condition of the site. The materials to be removed and stockpiled will be reviewed during the walk through. The walk through will be held on May 29th, 2025 at 2:00 PM, meeting at the project site, 123/123.5 North Main Street, Wharton, NJ 07885.

OBTAINING CONTRACT DOCUMENTS:

Contract Documents may be obtained only from the office of the Landscape Architect at 4 South Union Street, Suite 300, Lambertville, NJ 08530 Monday through Friday, except legal holiday, from 9:00AM to 4:00PM upon payment of eighty-five dollars ($85.00) for each set of Contract Documents. All refunds shall be forwarded in strict compliance with N.J.S.A. 40A:11-24(b).

BID SUBMISSION PROCEDURES: Bids must be submitted on the Bid Forms contained in the Contract Documents and must be enclosed in a sealed envelope plainly marked on the outside with the name of the project and the name and address of the bidder listed above. The bid must be delivered to the owner prior to bid opening at the above address, Attention: Borough Administrator. Bids will not be accepted after June 11, 2025, at 10:30 A.M.

PUBLIC BID OPENING AND READING: Bids will be opened and read aloud on June 11, 2025 at 10:30 A.M. in the Council Chambers of the Wharton Municipal Building, 10 Robert Street, Wharton, NJ 07885

BID SECURITY: Bid Security is required in an amount of not less than ten percent (10%) of the total amount of the Bid, but not in excess of Twenty-thousand Dollars ($20,000.00) as set forth in N.J.S.A. 40A:11-21.

CONSENT OF SURETY: Certificate from a Surety Company is required indicating consent to be bound as surety and grantor for performance required under the Contract Documents.

CONTRACTOR REGISTRATION: Bidders are required to be registered by the New Jersey Department of Labor at the time bids will be received by the owner pursuant to the Public Works Contractor Registration Act (P.L. 2003, c.91, N.J.S.A. 34:11-56.51).

STATUTORY REQUIREMENTS: Bidders are required to comply with applicable statutory requirements set forth in the Contract Documents including the requirements of N.J.S.A. 10:5-31, et seq & N.J.A.C. 17:27-1.1, et seq (Affirmative Action) and P.L. 1963, c. 150 (Prevailing Wage) and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et. Seq.), and P.L.2004, c.19 & P.L.2005, c.271 (Pay to Play).

REJECTION OF BIDS: The Borough of Wharton reserves the right to reject any or all bids, or to waive any bid defect where such defect is not detrimental to the best interest of the Borough and fairness of the bidding process. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Contract Documents.

Wharton is a community of approximately 7,346 residents in the highlands of Morris County. Wharton is located between Routes 15, 46 and 80, stretching south from the main entrance of Picatinny Arsenal, a major army research and development center, to Route 46 abounded on the west by Roxbury Township and the east by Dover and Rockaway Township. The Borough is approximately 2.2 square miles.

Town Hall is open until 7:30 p.m the second Thursday of the month (except for certain election weeks) and closes at 12:30 p.m. on the second Friday of the month.
